Man convicted in Van Dyn Hoven slaying continues appeals
Memories fading for investigators since 2000 case
APPLETON — Like so many hearings before, the Monday hearing for convicted killer Ken Hudson, who is claiming his innocence, resolved nothing.
Hudson, 39, is serving a life sentence for the June 25, 2000, stabbing death of Shanna Van Dyn Hoven, 19, of Kaukauna.
Since his 2001 convictions for first-degree intentional homicide, attempted first-degree homicide, attempted kidnapping and first-degree reckless endangerment, Hudson has maintained he was framed for her murder and has kept the appeals process going for the past seven years.
To buttress his claims that he was the victim of a conspiracy by law enforcement, every piece of evidence has come into question.
Hudson is represented by James Rebholz, his seventh attorney.
At Monday's hearing, six people testified, including a secretary and dispatcher from the Kaukauna Police Department, two jail employees, Kaukauna Assistant Chief Kevin Shephardson and Steven Malchow, an investigator for the district attorney's office.
At issue was the location and chain of custody of a tape of a jailhouse phone conversation, the sequence of events that led to the failure of a tape recorder when Hudson was interviewed, and what discovery items were delivered to Hudson in his jail cell.
The most common answer to Rebholz's questions was, "I can't remember."
"That I don't recall either," Shephardson replied when questioned about the handling of the blank interview tape.
"I will have to ask the court at some point the relevancy of these issues," said Dist. Atty. Carrie Schneider. "Was there adequate evidence to convict him? And if there were errors, were they harmless errors?"
Outagamie County Circuit Judge Harold Froehlich said the evidentiary questions are being asked at the behest of the court of appeals.
Rebholz said he is still pursuing a missing tape. "We have never been provided the tapes," he said. "The state has consistently said, 'You have them.'"
The hearing concluded with issues still unresolved. Froehlich did not schedule another hearing.
"Call me when you need me," Froehlich said.
